This offer is a written offer of the Seller to conclude a contract for the supply of patterns in the form of PDF files, contains all the essential terms of the supply contract and is sent to the Buyer in accordance with Art. 207, 641, 712 of the Civil Code of Ukraine (hereinafter referred to as the "CC") and is considered concluded in a simplified way, in accordance with Art. 181 of the Economic Code of Ukraine. The contract for the supply of patterns is concluded by accepting (accepting) the offer by the Buyer in the prescribed manner (clause 2 of article 642 of the Civil Code), which is considered an appropriate condition for concluding the contract (clause 2 of article 638 of the Civil Code). The following terms specified in the offer shall mean their following meanings:
Seller - Individual entrepreneur Olkhovskaya Vera Petrovna, whose goods are posted on the site https://cuturie.com.ua/
User – an individual, a site visitor who accepts the terms of the transaction and intends to place an order on the site https://cuturie.com.ua/
Buyer —The user who placed the Order on the site https://cuturie.com.ua/ for the purpose of purchasing goods for their own use.
Site —an online store located at: https://cuturie.com.ua/ , where the Goods offered for purchase by the Seller are presented, as well as the terms of payment and delivery.
Product — patterns in the form of PDF files with the Seller's logo posted for sale on the Seller's website. Pattern files are supplied on an "as is" basis - as is.
«As it is" means that the Seller sells and the Buyer buys the item in the condition it is currently in, and that the buyer accepts it "with all defects", whether immediately or not immediately.
Order - the Buyer's request for the purchase and delivery of the Goods selected on the site to the e-mail address specified by the Buyer - e-mail.
1. General provisions
1.1. The Seller sells the Goods through the Online Store at: https://cuturie.com.ua/
1.2. By ordering the Goods through the Online Store, the User agrees to the terms of the sale of the Goods, posted on the website. In case of disagreement, the User must leave the site https://cuturie.com.ua/
1.3. The current conditions for the sale of goods, as well as information about the goods posted on the site is a public offer in accordance with Art. 633 of the Civil Code of Ukraine.
1.4. The current conditions can be changed by the Seller unilaterally without notice to the User/Buyer. The new version of the terms of this agreement comes into force from the moment it is published on the website, unless otherwise provided by the agreement itself.
1.5. The Agreement becomes effective from the moment the Seller receives an electronic confirmation of payment for the Order.
1.6. By informing the Seller of his e-mail, the User/Buyer agrees to its use by the Seller for the delivery of the Goods in the form of a letter with a link or links for downloading the purchased pattern files in PDF format, as well as for the delivery of the Goods as an attachment to an e-mail.
2. Subject of a contract
2.1. The subject of the Agreement is the opportunity provided to the User to buy for personal, family, household needs, not related to the distribution and implementation of entrepreneurial activities, the Goods presented in the catalog of the Internet Store at https://cuturie.com.ua/
The files of the patterns purchased by the Buyer are transferred to the Buyer forever by downloading the files from the site on their own after paying for the order. Download links are active for 5 days after order payment. The Buyer must save the pattern files on his device. Information about the order is stored by the Seller for 1 year and the Seller can resend the files from the order during this period at the request of the Buyer.
Buyer smoking:
- Publicly post the acquired pattern files on the Internet, print media, the media, social networks without the written permission of Olkhovskaya V.P.
- Make changes to pattern files, convert PDF files of patterns into files of other formats indicating the actual dimensions of pattern details and post the files converted in this way on the Internet, printed publications, mass media, social networks without the written permission of Olkhovskaya V.P.
2.2 The User can use the materials of the Site and the services provided on the Site as follows:
- receive content from the Site on the screen of a personal computer or other device;
- print individual pages on paper and store those pages electronically on disk solely for personal, non-commercial use.
2.3 User smoking use the materials of the Site and the services provided on the Site as follows:
- photocopy, use materials from the Site for commercial or other purposes, other unauthorized use by publishing, rebroadcasting, distributing, performing, caching or in other ways;
- stored on any server or other storage device connected to the network.
2.4 The Seller is not responsible for the accuracy and correctness of the information provided by the Buyer during the ordering process.
3. Registration on the site is not required.
4. Product and purchase procedure
4.1. The Seller ensures the availability of the Goods presented on the Site. The photographs that accompany the Product are merely illustrations of the Product and may differ from the actual appearance of the Product. The descriptions and specifications that accompany the Product do not claim to be exhaustive and may contain typographical errors. 4.2. In the absence of the Goods ordered by the Buyer from the Seller, the latter has the right to exclude the specified Goods from the Order / cancel the Order by notifying the Buyer by sending an appropriate e-mail or by phone.
4.3. The Buyer is fully responsible for the provision of false statements, which made it impossible for the Seller to fulfill its obligations to the Buyer.
4.4. In the absence of a fully or partially prepaid Order, the Buyer is offered a replacement. In the absence of the Goods for replacement, the cost of the canceled Goods is returned by the Seller to the Buyer in the same way that the Goods were paid for earlier.
4.5. The Buyer's order is executed in accordance with the procedures specified on the Site "How to buy and how to download a pattern"
4.6. The maximum time for processing and collecting an order is 3 days. After placing an Order on the Website, the Buyer is provided with payment information.
5. Delivery of the Order
5.1. The method, as well as the estimated delivery time of the Goods, are indicated on the Site in the section "How to buy and how to download a pattern"
5.2. Orders are shipped worldwide. Free delivery.
5.3. Orders are dispatched within 24 hours from the time of order payment. A letter with identifiers for downloading the purchased files is sent to the e-mail address specified by the Buyer.
6. Price and payment for goods
6.1. The price of the Goods is indicated in dollars and includes all taxes provided by law. The invoice is issued and paid in the currency of the buyer's country.
6.2. The buyer can independently recalculate the cost of the goods in the currency of his country - the currency converter is located on the website on the right under the "New Patterns" section.
6.3. Payment for the Goods is carried out by the Buyer in non-cash funds by transferring funds to the store's accounts, depending on the country of residence and the method of payment chosen by the Buyer.
6.5. The Seller has the right to provide discounts on Goods and establish a bonus program. The types of discounts, bonuses, the procedure and conditions for their accrual indicated on the Site may be changed by the Seller unilaterally.
7. Return of goods and funds
7.1. The return of the Goods is carried out in accordance with the return conditions specified on the Site.
7.2. The Buyer has the right to refuse the received Goods and terminate the Purchase and Sale Agreement in accordance with the Law of Ukraine "On Protection of Consumer Rights" within 14 calendar days if he received the goods of inadequate quality, which must be established by the appropriate examination, which will exclude possible errors of the Buyer ( see section 7.8).
7.3. If the Buyer was given the Goods of inadequate quality, the Buyer has the right, in accordance with the Law of Ukraine "On Protection of Consumer Rights", to demand the return of the paid funds.
7.4. The Seller is not responsible for the defects of the Goods that arose after its transfer to the Buyer as a result of the Buyer's violation of the rules for using the Goods, the actions of third parties or force majeure circumstances.
7.5. The Seller undertakes to resend the Goods within a year if the Buyer can prove the fact of purchase by providing the Seller with the paid order number.
7.6. If the reason for the return was an error of the Seller of the Online Store, the full cost of the order is returned to the Buyer. The mistake of an employee of the Seller / Online Store means: sending a different model; sending a different size range (the buyer receives several sizes at once).

8. Confidentiality and information protection

8.4. The Seller has the right to send service messages that inform the User/Buyer about the Order and the stages of its processing. These messages are sent automatically and cannot be rejected by the User/Buyer.
8.5. The Seller has the right to use "Cookies" technology. Cookies do not contain confidential information and are not transferred to third parties.
8.6. The Seller is not responsible for the statements provided by the User/Buyer on the Site when placing an order.
8.7. The Seller has the right to record telephone conversations with the Buyer. At the same time, the Seller undertakes: to prevent attempts of unauthorized access to information received during telephone conversations, and / or its transfer to third parties that are not directly related to the execution of Orders, in accordance with the Law of Ukraine "On Information".
9. Duration of the public offer
9.1. The current public offer comes into force from the moment of its acceptance by the User/Buyer and is valid until the moment the acceptance of the public offer is withdrawn.
10. Special conditions
10.1. The Seller has the right to transfer its rights and obligations to the Buyers to third parties.
10.2. The Internet Store and related services may be temporarily/partially or completely unavailable due to preventive maintenance or other technical reasons. The technical service of the Seller has the right to periodically carry out the necessary preventive or other work with a previous message to the Buyers or without a message.
10.3. The provisions of the legislation of Ukraine apply to the relationship between the User/Buyer and the Seller.
10.4. In case of questions and claims from the User / Buyer, he must contact the Seller using the contacts posted on the Site. All disputes that arise, the parties will try to resolve through negotiations. If the parties do not come to an agreement, the dispute will be referred to the judicial authority in accordance with the current legislation of Ukraine.
